Users may be able to control cookies through their browser settings. Disabling certain cookies may affect website functionality.
11. Third-Party Services
Our website, software, or projects may integrate with third-party services, APIs, cloud infrastructure, payment providers, analytics platforms, communication systems, or other external technologies.
Those third parties may have their own privacy policies and terms.
Dork Industry is not responsible for privacy practices or security failures arising solely from third-party platforms outside our reasonable control.
12. Intellectual Property
Unless otherwise agreed in writing:
Dork Industry retains ownership of its pre-existing software, frameworks, libraries, methodologies, tools, templates, processes, know-how, and reusable components.
Customer-specific deliverables and intellectual-property rights will be governed by the applicable project agreement or Statement of Work.
Payment for a project does not automatically transfer ownership of Dork Industry’s underlying technology, reusable components, methodologies, or intellectual property.
13. Project Scope and Changes
Project requirements, timelines, costs, and deliverables will generally be defined in a proposal, quotation, purchase order, Statement of Work, or project agreement.
Changes to the agreed scope may affect:
Project cost
Delivery timeline
Resources required
Technical architecture
Testing requirements
Hardware requirements
Integration requirements
Additional work resulting from changes in requirements may be charged separately.
14. Project Delays
Dork Industry makes reasonable efforts to meet agreed project timelines.
However, delivery timelines may be affected by:
Changes in project scope
Delayed customer approvals
Delayed information or assets
Delayed payments
Infrastructure availability
Third-party dependencies
API or platform changes
Hardware availability
Integration complexity
Testing requirements
Regulatory or compliance requirements
Force majeure events
Other circumstances outside Dork Industry’s reasonable control
Project delay alone does not automatically constitute grounds for a refund.
Where Dork Industry has commenced work, allocated resources, performed development, engineering, consulting, design, procurement, integration, testing, or other project activities, payments relating to such work are not automatically refundable solely because the overall project timeline has changed.
15. Refund and Cancellation Policy
15.1 When a Refund May Be Considered
A refund may be considered where Dork Industry:
Fails to provide an agreed deliverable; or
Substantially fails to perform the contracted services,
subject to the applicable project agreement, Statement of Work, payment terms, completed work, deliverables, and applicable law.
A refund is not automatically guaranteed merely because a customer is dissatisfied with an intermediate stage of development.
15.2 Non-Refundable Project Work
Unless expressly agreed otherwise in writing, payments relating to work that has already commenced may be non-refundable, including:
Software development
ERP implementation
Customization
System integration
Hardware development
PCB or engineering work
Automation development
Research and development
Consulting
Technical design
UI/UX design
Configuration
Testing
Procurement
Deployment
Project management
Third-party services or expenses
This is because such work may involve committed personnel, engineering resources, development time, procurement costs, infrastructure, and third-party expenses.
16. Delays, Disagreements and Internal Conflicts
A customer may experience internal disagreements, management changes, changes in business strategy, project ownership changes, personnel changes, or other internal conflicts during a project.
Such circumstances do not automatically create a right to cancel the project and receive a refund for work already performed or resources already committed.
Similarly, disagreements regarding project direction, implementation approach, communication, intermediate results, or requested changes should first be addressed through the applicable project-management and dispute-resolution process.
Nothing in this policy excludes any rights or remedies that cannot legally be excluded under applicable law.
17. Customer-Caused Delays
Where a project depends on the customer providing information, approvals, content, access credentials, infrastructure, hardware, specifications, feedback, testing, payments, or other required inputs, failure or delay in providing those items may affect the project timeline.
Dork Industry may reasonably extend the delivery timeline where such dependencies prevent or materially delay project execution.
Such customer-caused delays do not automatically create a right to a refund.
18. Project Cancellation
If a customer requests cancellation after work has commenced, Dork Industry may calculate the amount payable based on:
Work completed
Resources already allocated
Development or engineering hours
Deliverables produced
Procurement commitments
Third-party costs
Infrastructure costs
Non-cancellable expenses
Other project commitments
Any remaining refundable amount, if applicable, will be determined according to the applicable agreement and applicable law.
19. Hardware and Physical Products
For hardware, devices, prototypes, PCBs, machinery integrations, sensors, automation equipment, or other physical products, additional terms may apply regarding:
Manufacturing
Procurement
Shipping
Installation
Testing
Warranty
Replacement
Defects
Custom configurations
Customized hardware or specially procured components may not be returnable or refundable once manufacturing or procurement has commenced, except where required by applicable law or expressly agreed in writing.
20. Estimates and Business Assessments
Any financial estimates, operational exposure calculations, productivity estimates, potential savings, revenue leakage estimates, headcount savings, production improvements, or ROI projections provided by Dork Industry are estimates based on information available at the time.
Actual results may differ due to operational, market, technical, financial, workforce, customer, or other circumstances.
Dork Industry does not guarantee a specific increase in revenue, reduction in costs, reduction in workforce, productivity improvement, or return on investment unless expressly guaranteed in a written agreement.
21. Free Audits and Assessments
Dork Industry may offer free operational assessments, technology assessments, factory audits, discovery sessions, or diagnostic reports.
A free assessment does not constitute a commitment by Dork Industry to implement every identified solution.
Following an assessment, Dork Industry may recommend software, ERP, automation, hardware, IoT, system integration, process redesign, consulting, or other solutions depending on the identified problem.
Where a physical factory visit or detailed technical audit is required, the scope and availability of such services may be agreed separately.
22. User Responsibilities
Users and customers are responsible for providing accurate and sufficiently complete information when requesting an assessment, quotation, or service.
Dork Industry is not responsible for conclusions or estimates materially affected by inaccurate, incomplete, outdated, or misleading information supplied by the customer.
